PRIVACY POLICY

Fad Mania, Inc. (“Fad Mania,” “us,” “we,” or “our”) operates the https://www.gamebytes.io/ website (the “Gamebytes Site”) and the Fad Mania mobile application (the “Gamebytes App”) (collectively, the “Services”). This Privacy Policy explains how we collect, use, disclose, and otherwise process personal data in connection with our Services.
 

  1. ​Our Collection of Personal Data​

When we use the term “personal data” in this Privacy Policy, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you. It does not include aggregated or anonymized deidentified information that is maintained in a form that is not reasonably capable of being associated with or linked to you.
 

From the first moment you interact with us, we are collecting personal data about you. Sometimes we collect personal data automatically when you interact with our Services and sometimes we collect the personal data directly from you. At times, we may collect personal data about you from other sources and third parties.
 

   a. Personal Data You Provide
 

We collect the following personal data you provide in connection with our Services:

  • Contact Information.  We may collect your name, phone number, email address and physical address as part of our offering of prizes or other communications between us and you.

  • Chat Information.  We collect any information you provide in the public chat, which we may associate with other information you have provided us.

  • Integrations.  If you integrate any third-party services within our Services, such as your contacts list, or your Snapchat Bitmoji, we collect this information for your use in the Services.

  • Communications.  If you contact us directly, we collect any information you choose to provide us.
     

   b. Personal Data Automatically Collected

 

As is true of most digital platforms, we collect certain personal data automatically when you visit our Services, including:
 

  • Usage Data.  We collect information that your browser or device sends whenever you use our Services, including your internet protocol (IP) address, operating system, browser type, browser version, the pages visited, the time and date of your visit and unique device identifiers.
     

  • Analytics Data.  We collect information about your use of our Services, including the electronic path you take through and your usage and activity on our services, such as the links and objects you view, click or otherwise interact with (also known as “Clickstream Data”). We use Google Analytics to collect such information.   • Cookies and Automatic Collection Tools.  We and our third-party partners use cookies and similar tracking technologies to collect information automatically about the activity on our Services. We also use beacons, tags, scripts and SDKs to collect information and improve and analyze our Services. If you would prefer not to accept cookies, most browsers will allow you to: (i) change your browser settings to notify you when you receive a cookie, which lets you choose whether or not to accept it; (ii) disable existing cookies; or (iii) set your browser to automatically reject cookies. However, if you do not accept cookies, you may not be able to use some portions of our Services.

    c. Personal Data from Other Sources and Third Parties

     

We also obtain personal data from other sources, which we often combine with personal data we collect either automatically or directly from you.  We receive the same categories of personal data as described above from the following sources and third parties:

  • Other Users.  If another user refers you to the Services, we will collect personal data about you from that user for the purposes of recommending the Services to you.

  • Integrations.  If you integrate any third-party services within our Services, such as your contacts list, or your Snapchat Bitmoji, we collect personal data from your account with the third-party services for the purpose of enabling the integration within our Services.

  • Service Providers.  We may collect information about you from our third-party marketing or recruiting service providers.

    2. Our Use of Data​

We use personal data we collect to:

  • Provide you our Services and fulfill your requests;

  • Enable your participation in the interactive features of our Service;

  • Register and service your account with us;

  • Communicate with you about our Services, your account with us, or other services that we believe may be of interest to you, including by phone, email or push notification;

  • Respond to your inquiries about our Services;

  • Provide technical support for our Services;

  • Perform analysis on how you use our Services;

  • Enhance our Services, including to build new features;

  • Enforce the legal terms that govern your use of our Services, including but not limited to our policies and Terms of Service;

  • Prevent, detect, or investigate fraud, technical issues or potentially illegal activities, such as copyright infringement;

  • Protect the safety and rights of our users, us and other third parties;

If you choose to contact us, we may need additional information to fulfill your request or respond to your inquiry. We may provide additional privacy disclosures where the scope of the request and personal data needed fall outside the scope of this Privacy Policy. In that case, the additional privacy disclosures will govern how we may process the information you provide at that time.

We disclose personal data in the following ways:

  • Service Providers.   We may employ third party companies and individuals to perform business-related functions on our behalf, such. These functions include conducting research and analytics, providing customer, technical, and operational support, fulfilling user requests, handling payments, hosting our Services, providing functionality on our Services and recruitment functions.

  • Business Transaction or Reorganization.  We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company assets. We may disclose personal data to a third-party during negotiation of, in connection with or as an asset in such a corporate business transaction. Personal data may also be disclosed in the event of insolvency, bankruptcy, or receivership.

  • Legal Obligations and Rights.  We may disclose personal data to third parties, such as legal advisors and law enforcement:

  • in connection with the establishment, exercise, or defense of legal claims;

  • to comply with laws or to respond to lawful requests and legal process;

  • to protect the rights and property of us, our agents, customers, and others, including to enforce our agreements, policies, and terms of use;

  • to detect, suppress, or prevent fraud;

  • to reduce credit risk and collect debts owed to us;

  • to protect the health and safety of us, our customers, or any person; or

  • as otherwise required by applicable law.

  • Consent:  We may disclose personal data about you to certain other third parties with your consent.

    4. International Data Transfers ​

Your information, including personal data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may not provide the same level of protection for personal data as the jurisdiction from which it was transferred. Please note that we may transfer the information, including personal data, to the United States, and process it there.​
 

​      5. Online Privacy Choices
 

      a. Online Advertising

We support the self-regulatory principles of the Digital Advertising Alliance (“DAA”). We work with advertisers, advertising networks, advertising servers, and analytics companies (“Ad Partners”) that use Clickstream Data and other automated collection technologies to understand how our Services are being used and to analyze your location and browsing history in order to deliver advertising relevant to your interests, as well as to provide advertising-related insights such as reporting, attribution, analytics, and market research.  These advertisements may appear on our Services or other websites or services, including through social media networks.  These Ad Partners may be able to associate devices across third-party websites or services over time and link various devices used by the same individual.
 

For more information about how Ad Partners use the information collected by these technologies and your options for restricting cookies placed by some of these Ad Partners, please visit the DAA’s opt-out page.  The DAA’s opt-outs are device- and browser-specific and may not work on all devices.  If you choose to opt-out through the DAA’s tools it does not mean you will cease to see advertising. Rather, the ads you see will be based on the website you are visiting and not your interests.
 

You may also be able to limit interest-based advertising through the settings menu on your mobile device by selecting “limit ad tracking” (iOS) or “opt-out of interest-based ads” (Android).  You may also be able to opt-out of some — but not all — interest-based advertising served by mobile ad networks by visiting http://youradchoices.com/appchoices and downloading the mobile AppChoices app.
 

​      b. Privacy Preferences

You have some choices regarding how we use your personal data, including the following:

  • Access to Your Device Information.  You may control the Services’ access to your device information through your “Settings” app on your device.  For instance, you can withdraw permission for the Services to access your contacts or integrations with your other applications.

  • How to Control Your Email Communications Preferences.  You can stop receiving promotional email communications from us by clicking on the “unsubscribe link” provided in such communications.  You may not opt-out of Service-related communications (e.g., account verification, transactional communications, changes/updates to features of the Services, technical and security notices).

  • How to Control Push Notifications. You can stop receiving push notifications from us by changing your preferences in the iOS or Android notifications settings menu.

  • Modifying or Deleting Your Information.  If you have any questions about reviewing, modifying, or deleting your information, you can contact us directly at support@fadmania.com.  We may not be able to modify or delete your information in all circumstances.

    6. Children's Personal Data​

Our Services are not directed to, and we do not intend to, or knowingly, collect or solicit personal data from children under the age of 13. If you are under the age of 13, please do not use our Services or otherwise provide us with any personal data either directly or by other means. If a child under the age of 13 has provided personal data to us, we encourage the child’s parent or guardian to contact us to request that we remove the personal data from our systems. If we learn that any personal data we collect has been provided by a child under the age of 13, we will promptly delete that personal data.
 

      7.Third-Party Integrations

Our Services may include links to third-party websites, plug-ins and applications. Except where we post, link to or expressly adopt or refer to this Privacy Policy, this Privacy Policy does not apply to, and we are not responsible for, any personal data practices of third-party websites and online services or the practices of other third parties.      7.1 Youtube Integration. You may choose to integrate YouTube videos into your live videos. To use this feature, you must authorize us to share information with YouTube, which becomes subject to YouTube’s terms and policies. If you would like to know more about how YouTube processes data, we recommend that you review the YouTube Terms of Services and the Google Privacy Policy. We do not control and are not responsible for any Personal Data or other information you share with YouTube.
 

     8. Changes to This Privacy Policy​

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know of any material changes via a prominent notice on the Gamebytes Site and/or the Gamebytes App, prior to the change becoming effective, and we will update the “last modified” date at the top of this Privacy Policy. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
